A reader of Budapest blog Urbanista noticed the improper installation of an air-conditioning unit on a renovated and listed building in Budapest’s District IX back in September 2010. After notifying the district, he received a response last week, saying that after a (no doubt exhaustive) investigation, the district would not take any measures against the offending air-conditioning unit, because in the course of the investigation, they realized they are part owners of the offending flat in question. Although they really would like to remove it, their hands are tied. Sorry! [urbanista.blog.hu]

So… They could have put it on the balcony, low enough not to be seen. I think that’s what the purpose of this city code is to begin with.
